Official Rules & Disclosures

1. Eligibility

• Open only to legal U.S. residents, age 18 or older, with a valid driver’s license.
• Must be able to legally register and insure a motor vehicle in Kentucky.
• Employees, officers, and directors of Swope Nissan, its affiliates, advertising agencies, and immediate family members are not eligible.
• Void where prohibited by law.

2. Contest Overview

• Contest begins August 15, 2025, at 10:00 AM at Swope Nissan, Elizabethtown, KY, the contest will continue until only one contestant remains.
• Contest format: Last Man Standing — participants must keep at least one hand on the designated vehicle at all times.
• The last remaining eligible contestant with continuous contact wins the prize.

3. Entry

• No purchase necessary, a purchase will not increase the participant’s chances of winning.
• All participants must complete and sign the Vehicle Giveaway Waiver & Release before competing.
• Space is limited to 60 contestants; entry will be on a first-come, first-served basis after online registrants have lined up.

4. Prize

• 2013 Nissan Rogue SV— provided AS IS, with no warranties, express or implied, the ARV (approximate retail value) is $2000.
• Prize is non-transferable; no cash or other substitutions will be offered.

5. Winner Responsibilities

• Winner is solely responsible for sales tax, title, registration, licensing fees, insurance, and any other costs associated with ownership.
• These costs must be paid in full before the vehicle will be released.
• Winner must present proof of valid auto insurance prior to taking possession.
• The fair market value of the vehicle will be reported to the IRS; winner will receive Form 1099 and is solely responsible for all federal, state, and local taxes.

6. Contest Rules

• Participants must maintain continuous contact with the vehicle using only one hand; contact must be skin-to-vehicle or through a thin glove.
• No leaning on the vehicle for support, sleeping, or using props to maintain contact.
• Any misconduct, unsafe behavior, or rule violations will result in immediate disqualification at the sole discretion of contest officials.
• Contestants will be observed by no less than two Swope Nissan appointed monitors and continuous live video through Facebook livestream.

7. Release of Liability

By participating, entrants agree to release, indemnify, and hold harmless Swope Nissan, its affiliates, employees, representatives, and agents from any and all claims, damages, injuries, or liabilities arising from:

• Participation in the contest,
• Acceptance, possession, or use of the vehicle,
• Any tax liability or subsequent mechanical issues.

8. Publicity Release

By accepting the prize, winner grants Swope Nissan the right to use their name, likeness, and statements for advertising, publicity, and promotional purposes without further compensation, unless prohibited by law.

Participant or winner information will not be used in any other promotion or sold to a third party.

9. Governing Law

• Contest is governed by the laws of the Commonwealth of Kentucky and applicable federal law.
• Any disputes will be resolved in the courts of Hardin County, Kentucky.

10. Acknowledgment

All participants must acknowledge that they have read, understand, and agree to abide by these rules and the Vehicle Giveaway Waiver & Release.
